By using, visiting and/or accessing any part (including, but not limited to, sub-domains, source code and/or website APIs, whether visible or not) of the www.on.bet365.ca website or mobile application or any other websites or applications that bet365 owns or operates (“the Website”) and/or registering with bet365, you enter into a contract with bet365, as agent for Woodbine Entertainment Group (“WEG”), and agree to be bound by these Terms and Conditions. For purposes of these terms, "you" and "your" means the Account holder.

These Terms and Conditions cover the use of the pari-mutuel wagering account established by you with WEG for Account Wagering and for Telephone/Internet account wagering in respect to WEG’s automated telephone account pari-mutuel wagering system (the “Account”) in connection with pari-mutuel wagers placed by you via the Website.

1. QUALIFYING FOR A WAGERING ACCOUNT:

In order to qualify for an Account, you confirm that you are a person 19 years or older who resides in Ontario.

You confirm that you have successfully completed the age and identity verification process conducted by the bet365 and have been approved by bet365 to conduct wagering activities on the Website (“Customer Information”). You hereby affirm all information provided by you to bet365 in this regard, and agree, where necessary, to the provision of this personal Customer Information to WEG by bet365.

bet365 will provide WEG with account credentials (“Account Credentials”) that will be used for the purpose of creating your Account. Your Account Credentials are linked only to you, and are used only to transmit your pari-mutuel wagers to WEG’s automated telephone account pari-mutuel wagering system.

2. ACCOUNT HOLDER RESPONSIBILITIES:

You agree to use the Account in accordance with the instructions and conditions in these Terms and Conditions, or as otherwise communicated to you from time to time by WEG.

You authorize WEG to accept, and you agree to be responsible for, all instructions sent to WEG, including to our totalisator system (the "WEG Tote System"), by such means as are made available by WEG, when accompanied by your Account Credentials.

The Account is for your personal use only. Any wager placed by a person other than you is strictly prohibited and will result in the immediate termination of your Account. You are legally responsible for all wagering placed through your Account via your Account Credentials.

Use of the Account is for use of placing bets only, in accordance with these Terms and Conditions. WEG is not responsible for any equipment not within its control. The risk of a technical corruption of an Account holder’s wager is on the Account holder.

3. DEPOSITS AND WITHDRAWALS:

Deposits and withdrawals of money from the Account must be made via your account with bet365 and are subject to the terms and conditions of the Website.

4. NO WAGER CANCELLATIONS:

Once placed, a wager cannot be changed or cancelled.

5. ACCOUNTS MAY BE CLOSED BY US:

WEG reserves the sole and exclusive right to close your Account for any reason whatsoever. Unauthorized or fraudulent use of the Account will result in immediate termination thereof, and may be punishable by law.

6. OFFER TO WAGER TERMS AND CONDITIONS:

All offers to wager made by WEG to you, are made subject to these Terms and Conditions, including without limitation, the following specific Terms and Conditions:

1. bet365 confirming that you have met the age and identification criteria required for use of the Website for wagering purposes and that all Customer Information provided for this purpose is true and accurate;

2. bet365 determining that all Account information entered on the Website is correct;

3. the wager placed meeting the minimum betting amount as per the host track and CPMA requirements;

4. sufficient funds to place the wager being available in your Account;

5. the notice of acceptance of the offer to wager being received at the WEG Tote System;

and

6. the WEG Tote System not having closed its pari-mutuel pool for wagering on the race in respect of which the wager is placed, at the time notice of acceptance of the offer to wager is received at the WEG Tote System.

7. RECORDING OF WAGERS:

You hereby consent to the recording of all Account transactions and calls and the CPMA’s monitoring of the said transactions and calls. The CPMA can be contacted respecting any regulatory concerns to your Account by calling toll free at 1-800-268-8835.

8. LIMITATION OF LIABILITY:

EXCEPT AS EXPRESSLY STATED HEREIN, WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE OPERATION OF THE ACCOUNT, INCLUDING YOUR ABILITY TO EFFECTIVELY WAGER VIA THE ACCOUNT. WITHOUT IN ANY WAY LIMITING THE FOREGOING, ALL IMPLIED WARRANTIES FOR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. You acknowledge that you have read this paragraph, agree that it has been specifically NEGOTIATED and agree that this paragraph is an integral part of the Terms and Conditions of your agreement with us. For certainty, in no event shall we be liable to you for any losses or damages incurred by you or any other party resulting from your establishment or use of the Account, except that resulting from our gross negligence or fraud, and including without limitation ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OR ANY LOSS OF PROFITS. IN NO EVENT SHALL OUR LIABILITY FOR ANY CLAIM EXCEED THE COST OF YOUR WAGER AND YOU AND WE AGREE THAT SUCH AMOUNT IS A GENUINE PRE-ESTIMATE OF ANY LOSS OR DAMAGE WHICH MAY BE INCURRED, ARISING FROM ANY CAUSE WHATSOEVER.

9. INDEMNIFICATION:

You agree to indemnify and hold harmless WEG and its directors, officers, employees and agents, from all claims, liabilities, losses or damages whatsoever incurred, arising from or by reason of your failure to comply with these Terms and Conditions.

10. RIGHT TO CHANGE TERMS AND CONDITIONS:

We reserve the right to make changes to these Terms and Conditions or any of them at WEG’s sole discretion at any time and from time to time, with any such changes taking effect immediately. Your continued use of the Account constitutes acceptance of such amended Terms and Conditions.
